Terms and Conditions: Pack ECO Brushboo

1. Identification of the organizer

The company Brushboo S.L, with registered office at Guzman el Bueno, 41, Bajo B ,28015-with CIF B88200894 has organized this raffle.

1. Start and end dates of the draw

The start date of the draw will be Monday, February 14, 2022 at 12am and will end on Sunday, February 21 at 11:59pm. The winner of the drawing will be announced on Monday, February 22 at 12:00am.
BRUSHBOO reserves the right to postpone or extend the period of the sweepstakes in case of force majeure, as well as the right to interpret these legal terms and conditions.

1. Drawing mechanics and participation requirements

The sweepstakes will be open to individuals over 18 years of age who reside in Spain and have a real user profile on Instagram.

Employees of the company or of the other companies of the BRUSHBOO group may not participate, nor of the rest of the companies of the group to which BRUSHBOO belongs, fraudulent profiles may not participate.fraudulent profiles and/or sweepstakes experts.

To participate you must meet the requirements indicated in the sweepstakes publication that appears in the feed:

2. Follow @brushboo’s profile
3. Comment by mentioning a real user.

Once the participation has been made, it will not be possible to make changes in the draw. Brushboo reserves the right to make changes to the sweepstakes during its development, if any cause should arise that prevents it from being carried to a successful conclusion or in order to improve its progress.

1. Selection of the winner and mode of the drawing.

The winner will be chosen by the BRUSHBOO team at AppSorteos. The name of the winner will be announced on Monday, February 22 at 12:00am. The winner must contact us via private message to manage the prize. If no response is received from the selected winner within 72 hours, the prize will be passed on to an alternate.

The winner must live in Spain or have a home/family where the shipment can be made in Spain.

BRUSHBOO is exempt from any responsibility in case of any error in the data provided by the winners / alternates that prevents their identification.

1. Value and nature of the award offered

The prize will consist of a Brushboo ECO Pack consisting of a thermos valued at €29.90, a cutlery set valued at €14.90, a daily use shampoo valued at €7.50, a hand soap valued at €7.50 and a pack of 2 toothbrushes valued at €8.50. The total value of the pack is €68.30 incl. VAT. BRUSHBOO is not responsible for the tax impact of the prize for the winner.

1. Notification of winners

The winner will be notified on Instagram. If no response is received within 72 hours, the prize will be passed on to the alternate, who will also have 72 hours to respond. Notification will be made in stories within 24 hours of the sweepstakes and the story with the winners will be posted on the profile. Brushboo’s Instagram post will also be modified.

Once the winner has been notified, he/she will be given the necessary instructions to access his/her prize.

Once the prize is offered to the alternate, the previous winner will forfeit the right to claim the prize.

1. Assignments of image rights and/or intellectual property rights

The participants and winner will cede the exploitation rights of their comments to BRUSHBOO company for the sweepstakes.

By participating they also agree to the assignment of their username and public profile picture on Instagram for the purpose of being published on BRUSHBOO profiles.

If the time period is not specified, the exploitation rights are understood to be assigned by the Intellectual Property Law for a period of 5 years. If the territory is not specified, the exploitation rights for the territory in which the assignment is made are understood to be assigned by said Law.

1. Post or comments

Comments whose content is considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties are not allowed.

BRUSHBOO may remove such posts, or even disqualify participants who include this type of content.

1. Disqualifications and penalties

We will understand as fraud the use of platforms, fake profiles or independent applications for more entries in the sweepstakes, as well as behaviors that we detect as apparently abusive and/or malicious.

The verification of any of these practices will result in the disqualification of the sweepstakes that we consider to have arrived through channels not allowed in the campaign. BRUSHBOO reserves the right to take legal action against any person who performs any act that could be considered as manipulation or falsification of the sweepstakes.

BRUSHBOO is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the operation of the application through which you participate in the sweepstakes, the defrauding of the utility that users may have attributed to it and access to the different pages and sending participation responses via the Internet.

1. Exoneration of the organizer’s liability in case of default by participants

BRUSHBOO is not responsible in case the winner misuses the prize or does not comply with the provisions of the legal bases.

1. Protection of personal data

The personal data of the participants provided to BRUSHBOO in the realization of this sweepstakes will be treated confidentially as Data Controller for the following purposes: (i) Manage the participation in the Sweepstakes of the participants and delivery of the prize to the winner (ii) Communicate that they have been winners of the sweepstakes. (iii) Public use of your data and image in the case of winning the Sweepstakes. This treatment requires your consent, which, once given, may be revoked at any time as indicated in point 7.

Participation in the sweepstakes implies acceptance of these legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, BRUSHBOO will be released from the fulfillment of the obligation contracted with this participant.

The applicable law shall be Spanish law and the jurisdiction in case of conflict shall be, according to the Law, the courts and tribunals of Madrid.
